Formation of contract and cancellations

A contract will only be formed between Memories 2 Disc and you once we have given to you written notice (either by letter or email) of our acceptance of your order and receipt of your payment. By sending us the order form (either via our website or in the post) to Memories to Disc to start work on your order, your cancellation rights will end as soon as Memories to Disc starts work on your order (where you wish us to provide services).

Sending and Returning Your Source Media

You are strongly advised to use a delivery service that requires a “signature on delivery” when sending your media and any payment to Memories 2 Disc. Depending on your instructions, Memories 2 Disc will use Royal Mail Signed For, Royal Mail Special Delivery, Royal Mail Parcel Force (or an equivalent delivery service) providing signature on delivery, web-based tracking facilities and insurance. On the order form, you have a choice of which delivery service you require, or your media can be collected in person from our premises with prior arrangement. Any dispute regarding loss or damage of your goods in transit should be taken up directly with the delivery company you have requested.

Safety of your Source Material

In the unlikely event of Memories 2 Disc being the cause of damage to or loss of any of your media, your media will be replaced with a blank replacement (video tape, camcorder, or roll of film) only and the return delivery costs to you will be paid. This does not apply to tapes that have arrived in a damaged or unusable state or tapes that are damaged during playback due to defects or simply being very old. In this case, the customer must cover all return postage and packaging costs before their materials are returned.

Turnaround Time

We aim to complete and dispatch your order within 10 working days from receipt of cleared payment from you; however, at busy times please allow up to 6 weeks. Orders of 10 or more tapes or additional copies will be subject to our current workload and seasonal trends. Please enquire at the time of ordering if you have any particular deadline for completion of the work.

Privacy and Confidentiality Policy

We promise to respect the privacy and confidentiality of your identity and audio visual material. We will not supply your contact information to any third party unless you specifically ask us to. Where we are required by law, we will release information or material submitted to Memories 2 Disc to the Courts or to the Police.

From time to time we would like to email you with special offers and other related news. Your email address will only be held electronically if you give us your consent to do so. There will be an option to unsubscribe in each email newsletter.

We cannot accept responsibility for mis-interpretations of handwriting or mis-spellings and if we cannot read the writing. Where text is to be including in the order or the packaging, Memories 2 Disc cannot be held responsible for spelling / grammar errors where the text is not supplied in a clear typed format. We will attempt to read handwritten text, but if the words are spelt incorrectly, the customer will be responsible for the cost involved in re-doing the work.

DVD Format

As standard, DVD’s are region-free and play in PAL. We use Verbatim DVD-R Discs
If you wish your footage to be transferred to a DVD+R instead, please advise at the time of ordering.
We can produce NTSC DVD, however we do make an additional charge for this.

Payment

All prices quoted are in UK Pounds (Sterling) and are inclusive of VAT.

Payment must be sent with the order if not already paid when processing the order online. We will not undertake any work until payment is received.

We accept payment online by Debit/Credit card. By prior arrangement with Memories 2 Disc, payment can be made by Cheque or Bank Transfer using Faster Payments System with your Bank if delivering your order in person to us. Any cheques must be made payable to Memories 2 Disc.

Our Rights to update our website (Information, Prices and Services)

It is important for us to be able to alter information, pricing and services to meet customer needs and to remain competitive whilst providing a professional service. We therefore reserve the right to modify our website, services and pricing at any time. However, we will honour your order should it be placed up to 2 weeks after the change. Memories 2 Disc will apply either the price at the time of the order or the new prices (whichever is in your favour).

Content of Film / Disclaimer

By submitting an order to Memories 2 Disc, I (the customer) represent and warrant that:

I am not infringing the intellectual property of any other person contained in the material submitted and I have the right to permit Memories 2 Disc to perform their services I have requested on videotape/camcorder tape/photos/slides/digital media card or storage device I have submitted. The content of the material and the provision of the processing service on my behalf is not for any illegal, obscene, offensive or immoral purpose.

Neither the Content nor the provision of the processing and/or hosting of the Content will injure, infringe, or violate any patent, copyright, trade secret, trademark or intellectual property rights of any third party (including but not limited to any performance licence rights, mechanical licence rights or synchronization licence rights) or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction in which the Content may be viewed or retrieved.

Memories 2 Disc have the right to reject any work I submit to them for copying and converting which they feel is contrary to the above. I agree to pay Memories 2 Disc postage and packaging costs to return my rejected material to me.
I also agree that Memories 2 Disc, and its employees shall not be otherwise liable to me for any loss or damage of any kind or nature (including but not limited to loss of enjoyment, distress, discomfort or inconvenience), whether direct, incidental, consequential, or otherwise. In the event of loss of or damage to the materials caused by Memories 2 Disc, then I agree and acknowledge that Memories 2 Disc shall be liable to compensate me to the value of the sum of money actually paid by me. This limit of liability will not apply in the event of personal injury suffered by me or in the event of fraud or manifest dishonesty on the part of Memories 2 Disc

I will indemnify and hold Memories 2 Disc harmless in respect to any claim of violation of such laws. I declare the materials submitted were either created under my copyright or that I have permission of the copyright owner to convert/transfer/duplicate them and that I consent (including on behalf of any third party) to processing of any images of recognisable individuals.
